Freedom Code Compliance, Inc. ("FCC," "we," "us," or "our") is Florida's premier licensed private provider authorized to conduct virtual plan reviews and building inspections pursuant to Florida Statute § 553.791. These Terms and Conditions ("Terms") govern your access to and use of our website at freedomcodecompliance.com, our mobile applications (myFCC for iOS and Android), our web platform (myFCC Desktop), and all related professional services (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company, you represent that you have authority to bind that entity. If you do not agree to these Terms, you must not use our Services.
1.Eligibility and Account Registration
1.1 Eligibility
To use our Services, you must: (a) be at least 18 years of age; (b) be a licensed contractor, building professional, property owner, or authorized representative with a legitimate interest in building code compliance services in the State of Florida; (c) have the legal capacity to enter into binding contracts; and (d) not be prohibited from using our Services under applicable law.
1.2 Account Registration
You must create an account to access most Services. You agree to provide accurate, current, and complete registration information; maintain and update your account; protect your login credentials; accept responsibility for all account activities; and notify FCC immediately at support@freedomcodecompliance.com of any unauthorized use.
1.3 Professional Credentials
Licensed professionals using our Services must maintain valid licenses in good standing with the applicable Florida licensing authority. FCC reserves the right to verify credentials through the Florida Department of Business and Professional Regulation (DBPR) and other official sources at any time. Misrepresentation of professional credentials constitutes a material breach of these Terms and is grounds for immediate account termination.
2.Description of Services
2.1 Virtual Plan Review
FCC's licensed building officials review construction documents electronically for compliance with the Florida Building Code and applicable local amendments, including architectural, structural, mechanical, electrical, and plumbing plans.
2.2 Virtual Building Inspections
State-licensed inspectors conduct building inspections remotely via live video or asynchronous media review throughout all phases of construction, serving licensed contractors and building departments exclusively within the State of Florida.
2.3 Certificates of Compliance
Upon successful completion of required plan reviews and inspections, FCC issues Certificates of Compliance (CoC), Certificates of Occupancy (CoO), and related compliance documentation in accordance with Florida Statute § 553.791.
2.4 Digital Platform
FCC provides access to the myFCC mobile application (iOS and Android), myFCC Desktop web platform, fccPRO inspector workstation, and fccOPS operations portal for project management, document submission, inspection scheduling, compliance tracking, and communications.
2.5 Geographic Scope
Our Services are available exclusively within the State of Florida. FCC is authorized to provide private provider services pursuant to Florida law and does not offer services outside Florida.
2.6 Service Availability
FCC will make commercially reasonable efforts to maintain platform availability but does not guarantee uninterrupted or error-free access.
3.Service Orders, Quotes, and Acceptance
3.1 Quote Process
All services begin with a formal quote issued through the platform outlining scope, deliverables, fees, and estimated turnaround times.
3.2 Acceptance
By accepting a quote within the platform, you authorize FCC to proceed with the ordered services and agree to pay the stated fees.
3.3 Turnaround Times
FCC targets industry-leading turnaround times, typically 24–72 hours for standard plan reviews. Timelines may vary based on project complexity, submission completeness, and inspection scheduling availability.
3.4 Submission Requirements
Clients are responsible for submitting complete and accurate documentation. FCC may reject incomplete submissions and may charge additional fees for re-reviews necessitated by incomplete initial submissions.
4.Fees and Payment
4.1 Fees
Service fees are as quoted and accepted through the platform. All fees are denominated in U.S. dollars. FCC reserves the right to update its fee schedule with reasonable advance notice.
4.2 Payment Terms
Payment is due upon invoice unless otherwise agreed in writing. FCC accepts payment via credit card, ACH bank transfer, and other methods available within the platform. Payment processing is handled by authorized third-party processors. FCC does not store full payment card information.
4.3 Late Payments
Invoices unpaid within 30 days of the due date may accrue interest at 1.5% per month or the maximum rate permitted under Florida law, whichever is lower. FCC reserves the right to suspend Services for accounts with outstanding balances.
4.4 Refunds
Service fees are generally non-refundable once work has commenced. Requests for refunds on services not yet commenced will be reviewed on a case-by-case basis. Approved refunds are processed to the original payment method within 10 business days.
4.5 Taxes
You are responsible for all applicable taxes and duties associated with your use of our Services, except for taxes based on FCC's net income.
5.User Obligations and Acceptable Use
5.1 Accurate Submissions
You agree to submit only accurate, complete, and lawful documentation. Submission of falsified, fraudulent, or materially misleading documents constitutes a material breach of these Terms and may violate Florida law.
5.2 Legal Compliance
You agree to use the Services in full compliance with all applicable federal, state, and local laws, including the Florida Building Code, Florida licensing requirements, and applicable professional standards.
5.3 Prohibited Conduct
You agree not to:
- Submit forged, fraudulent, or altered documents
- Misrepresent your identity, credentials, or authorization
- Access or attempt to access accounts or data belonging to other users
- Use automated tools, bots, or scrapers without written permission
- Reverse engineer or extract source code from our platform
- Transmit malware or harmful code
- Interfere with platform integrity or performance
- Resell access to our Services without written authorization
5.4 Third-Party Information
When submitting information about property owners, contractors, or other third parties, you represent that you have legal authority and appropriate consent to share that information with FCC.
6.SMS and Text Message Communications
6.1 Consent to Receive SMS
When you check the SMS consent box and provide your mobile number through our website or account flows, you expressly agree to receive informational SMS/text messages from Freedom Code Compliance, Inc. at the number you provide. Message types include:
- Project status updates and milestone notifications
- Inspection scheduling confirmations and reminders
- Quote delivery and acceptance notifications
- Document submission confirmations and requests
- Certificate of Compliance issuance notifications
- Billing alerts and payment confirmations
- Account security and two-factor authentication messages
- Service announcements and operational updates
Consent is not a condition of purchase. Our SMS consent language appears at the point where we collect your mobile number and links to these Terms and our Privacy Policy.
6.2 Message Frequency
Message frequency varies based on your project activity. You may receive multiple messages per day during active project periods.
6.3 Opt-Out
Reply STOP to any text message from FCC to opt out of non-essential SMS communications. After receiving your STOP request, FCC will send one final confirmation message and will cease non-essential SMS to your number. Note: opting out does not remove you from essential service communications required to fulfill active engagements.

6.5 Message and Data Rates
Message and data rates may apply. Charges are billed by your wireless carrier. FCC is not responsible for fees charged by your carrier.
6.6 Carrier Disclaimer
FCC and its messaging service partners are not liable for delayed or undelivered messages. Message delivery is subject to your carrier's coverage and network policies.
6.7 Supported Carriers
FCC's SMS services are available on all major U.S. wireless carriers including AT&T, Verizon, T-Mobile, US Cellular, and others.
7.Intellectual Property
7.1 FCC Ownership
All intellectual property comprising the FCC platform — including software, design, trademarks, service marks, logos, documentation, and proprietary methodologies — is owned exclusively by Freedom Code Compliance, Inc. or its licensors. No ownership rights transfer to you under these Terms.
7.2 Limited License
Subject to your compliance with these Terms, FCC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform solely for your internal business purposes related to building code compliance in the State of Florida.
7.3 Client Content
You retain ownership of documents, plans, photos, and other content you submit ("Client Content"). By submitting Client Content, you grant FCC a non-exclusive, royalty-free license to use, process, store, and transmit that content solely as necessary to provide the Services.
7.4 Feedback
Any feedback or suggestions you provide may be used by FCC without obligation, and FCC shall own all improvements derived from such feedback.
8.Confidentiality
8.1 Mutual Obligation
Each party agrees to maintain the confidentiality of non-public information disclosed by the other and to use such information only to perform under these Terms.
8.2 Exceptions
Confidentiality obligations do not apply to information that: (a) becomes publicly available without breach; (b) is independently developed; (c) is required to be disclosed by law or court order; or (d) must be shared with Florida building departments to provide the Services.
8.3 Florida Public Records
Client Content transmitted to Florida building departments as required by applicable law becomes subject to the Florida Public Records Act, Chapter 119, Florida Statutes. FCC has no liability for disclosure of such records pursuant to valid public records obligations.
9.Privacy
Our collection, use, and protection of personal information is governed by our Privacy Policy, available at freedomcodecompliance.com/legal/privacy, incorporated into these Terms by reference. By using our Services, you consent to the data practices described in our Privacy Policy.
10.Disclaimers and Limitation of Liability
10.1 As-Is Basis
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND — EXPRESS, IMPLIED, OR STATUTORY — INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.
10.2 Professional Judgment
FCC's plan reviews and inspections reflect the professional judgment of licensed inspectors and plans examiners at the time of review, based solely on documentation submitted and Florida Building Code requirements in effect at that time. FCC does not warrant that reviewed plans or inspected work are free from all defects or code violations outside the scope of review.
10.3 No Consequential Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FCC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOST BUSINESS OPPORTUNITY, OR REPUTATIONAL HARM — EVEN IF FCC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.4 Liability Cap
FCC'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) ALL FEES PAID BY YOU TO FCC IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
10.5 Essential Basis
The disclaimers and liability limitations herein are a fundamental part of the basis of the bargain between you and FCC. FCC would not provide the Services without these limitations.
11.Indemnification
You agree to indemnify, defend, and hold harmless Freedom Code Compliance, Inc. and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, losses, costs, and attorneys' fees arising from or related to: (a) your use of or access to the Services; (b) your violation of these Terms; (c) your submission of inaccurate, fraudulent, or unauthorized documentation; (d) your violation of any applicable Florida or federal law; or (e) your misrepresentation of professional credentials or authority.
12.Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
12.2 Binding Arbitration
Any dispute that cannot be resolved through good-faith negotiation shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall be conducted in Miami-Dade County, Florida. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
12.3 Class Action Waiver
ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST FCC.
12.4 Equitable Relief
Either party may seek injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration resolution.
12.5 Jurisdiction
For matters not subject to arbitration, the parties consent to the exclusive jurisdiction of state and federal courts located in Miami-Dade County, Florida.
13.Term and Termination
13.1 Term
These Terms take effect upon your first access to or use of the Services and remain in effect until terminated.
13.2 Termination by You
You may close your account at any time by contacting support@freedomcodecompliance.com. Termination does not relieve you of payment obligations for services already rendered.
13.3 Termination by FCC
FCC may suspend or terminate your access immediately for:
- Material breach of these Terms
- Non-payment
- Fraudulent, illegal, or harmful conduct
- Failure to maintain required Florida professional credentials
- Any other reason FCC reasonably determines warrants termination
13.4 Effect of Termination
Upon termination, your license to use the Services ceases immediately. Sections 7, 8, 10, 11, 12, and 14 survive termination.
14.General Provisions
14.1 Entire Agreement
These Terms, together with the Privacy Policy and any executed service agreements, constitute the entire agreement between you and FCC and supersede all prior agreements, representations, and understandings.
14.2 Modifications
FCC may update these Terms at any time. Material changes will be communicated with at least 14 days' advance notice via email or in-platform notification. Continued use after the effective date constitutes acceptance of the revised Terms.
14.3 Severability
If any provision is found unenforceable, it will be modified to the minimum extent necessary to be enforceable, and remaining provisions remain in full effect.
14.4 Waiver
FCC's failure to enforce any right or provision shall not constitute a waiver of future enforcement.
14.5 Assignment
You may not assign these Terms without FCC's prior written consent. FCC may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
14.6 Force Majeure
Neither party shall be liable for delays caused by circumstances beyond their reasonable control, including natural disasters, government actions, labor disputes, or infrastructure failures.
14.7 No Third-Party Beneficiaries
These Terms are for the benefit of FCC and you only and create no rights in any third party.
